These Terms of Service ("Terms") govern your use of the website operated by The Print Expert and the print and signage services we provide. By accessing our website, submitting a quote request, placing an order, or engaging our services in any way, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
In these Terms, "we", "us" and "our" refer to The Print Expert. "You" and "your" refer to the individual or business engaging our services or accessing our website. "Services" means all print, signage, branding and related services provided by The Print Expert.
1. Acceptance of Terms
By placing an order or engaging The Print Expert for any service — whether verbally, in writing, via email, WhatsApp, or through our website — you confirm that you have read, understood and agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms communicated to you in writing in relation to a specific project.
These Terms constitute the entire agreement between you and The Print Expert in respect of the services, and supersede all prior representations, agreements or understandings.
2. Our Services
The Print Expert provides the following categories of services:
- Digital printing (business cards, brochures, flyers, stationery, catalogues, and related items)
- Offset printing (high-volume commercial print, publications, packaging, and related items)
- Large format printing (banners, vehicle wraps, exhibition displays, wall murals, and related items)
- Promotional and branded merchandise
- Indoor and outdoor signage fabrication and installation
- 3D signs, billboards, pylon signs, and large-scale structural signage
- Graphic design and pre-press services
We reserve the right to decline any order at our discretion, including orders that contain unlawful, offensive, defamatory, or infringing content.
3. Quotations & Pricing
All quotations provided by The Print Expert are valid for fourteen (14) days from the date of issue, unless otherwise stated in writing. Quotations are based on the specifications provided at the time of enquiry. Changes to quantities, materials, finishes, sizes, or artwork after a quotation is issued may result in revised pricing.
Prices quoted are exclusive of value added tax (VAT) or any other applicable taxes unless expressly stated otherwise. Delivery, installation, and any applicable government levies will be itemised separately where applicable.
We strive to maintain price accuracy; however, we reserve the right to correct any errors in pricing before an order is confirmed. In such cases, we will notify you and offer the option to proceed at the corrected price or cancel the order.
4. Orders & Confirmation
An order is considered confirmed only when:
- You have provided written confirmation of the order (including by email or WhatsApp message);
- Approved artwork or a signed proof has been received; and
- Any required deposit payment has been received and cleared.
We will not commence production until all three conditions are satisfied. Verbal instructions alone do not constitute a confirmed order, and The Print Expert accepts no liability for delays arising from incomplete order confirmation.
By confirming an order, you warrant that you have the authority to place the order and that the artwork and content supplied do not infringe any third-party rights.
5. Artwork & Files
5.1 Client-Supplied Artwork
Where you supply artwork files for production, you are responsible for ensuring that:
- Files are supplied in the correct format (PDF, AI, EPS, or high-resolution TIFF/JPEG as specified);
- All images and graphics are at a minimum resolution of 300 dpi at final print size;
- All fonts are embedded or outlined;
- Colour mode is set to CMYK (or Pantone where specified);
- Bleed and safe zones are applied correctly as per our supplied specifications;
- You hold all necessary licences and rights for all content, images, logos, and fonts supplied.
The Print Expert is not responsible for print quality issues arising from artwork that does not meet our technical specifications. We will advise you of any file issues identified during pre-press, but it remains your responsibility to supply print-ready files.
5.2 Design Services
Where The Print Expert provides design or artwork services, up to two rounds of revisions are included in the quoted price. Additional revisions beyond this will be charged at our prevailing hourly rate. Final ownership of completed design work transfers to you upon full payment of all outstanding invoices.
6. Proofs & Approvals
A digital soft proof will be provided for your approval before production commences. Physical press proofs are available on request and will be charged accordingly.
You are responsible for checking all proofs carefully, including text content, spelling, layout, colours, dimensions, and any other details. Once you provide written approval of a proof, The Print Expert proceeds to production based on that approved file. We accept no liability for errors that were present in the approved proof.
Screen colours vary between devices and do not constitute an accurate representation of final print colour. Colour accuracy relative to a physical standard or Pantone reference must be specified and agreed in writing before order confirmation.
7. Production & Turnaround
Production commences only after receipt of a confirmed order, approved proof, and required deposit. Estimated turnaround times are provided in good faith and commence from the date all three conditions are met — not from the date of initial enquiry.
Turnaround times are estimates and not guaranteed delivery dates. Factors outside our control — including but not limited to equipment maintenance, supplier delays, weather events, or force majeure — may affect production timelines. We will communicate any significant delays promptly.
Rush or same-day production services are available on select products subject to capacity and will attract a surcharge as quoted.
8. Delivery & Installation
Delivery within Dar es Salaam is available and will be quoted separately. Risk of loss or damage to goods passes to you upon delivery to your specified address or upon collection from our premises.
For signage installation projects, we will agree a site visit and installation schedule with you in advance. You are responsible for ensuring that the installation site is accessible, prepared, and that all necessary permissions and structural approvals have been obtained. The Print Expert is not liable for delays or additional costs arising from site conditions outside our control.
Upon delivery or collection, please inspect all goods immediately. Any damage or discrepancies must be reported to us in writing within 48 hours of receipt. Claims made after this period may not be accepted.
9. Payment Terms
9.1 Standard Payment Terms
Unless otherwise agreed in writing, our standard payment terms are:
- New clients and one-off orders: 50% deposit upon order confirmation, balance due upon completion before delivery or collection.
- Established clients on account: Payment due within 14 days of invoice date, as agreed in a credit application.
- Large-scale signage and installation projects: Payment schedule as agreed in the project proposal (typically 50% deposit, 25% on commencement of fabrication, 25% on completion).
9.2 Late Payment
Invoices not paid by the due date may attract interest at a rate of 2% per month on the outstanding balance. We reserve the right to withhold delivery of goods or pause ongoing work until overdue invoices are settled. In cases of persistent non-payment, we may refer the matter to a debt collection agency and recover associated costs from the outstanding balance.
9.3 Payment Methods
We accept payment by bank transfer, mobile money (M-Pesa, Tigo Pesa, Airtel Money), or cash. Payment details will be provided on your invoice.
10. Cancellations & Changes
Once an order has been confirmed and production has commenced, cancellation may not be possible. Where cancellation is accepted, you will be liable for all costs incurred to the point of cancellation, including materials, labour, design work, and any subcontractor fees.
Changes to confirmed orders (including quantities, sizes, artwork, or specifications) must be requested in writing before production commences. Changes requested during or after production may result in additional charges and extended turnaround times.
Deposits paid are non-refundable in the event of cancellation after production has commenced.
11. Quality & Complaints
We are committed to delivering work of the highest quality. If you are dissatisfied with any product or service, please contact us in writing within 5 business days of receipt, providing a clear description of the issue and supporting photographs where applicable.
We will investigate all complaints fairly and promptly. Where a manufacturing defect or production error on our part is confirmed, we will at our discretion either reprint the affected items or provide a credit or refund, as appropriate.
We do not accept responsibility for errors that were present in approved proofs, artwork supplied by the client that did not meet our technical specifications, or minor colour variations that fall within industry-standard tolerances for the print process used.
Industry-standard colour tolerance of plus or minus 5% is accepted for CMYK print. Where exact colour matching is critical, Pantone colour referencing must be specified and agreed in writing before order confirmation.
12. Limitation of Liability
To the fullest extent permitted by applicable law, The Print Expert's total liability to you in connection with any order or service shall not exceed the total amount paid by you for that specific order or service.
We shall not be liable for any indirect, consequential, special, incidental or punitive damages, including loss of profit, loss of business opportunity, loss of goodwill, or reputational harm, even if we have been advised of the possibility of such damages.
We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, strikes, government actions, utility failures, or interruptions to supply chains.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited by law.
13. Intellectual Property
13.1 Client Content
You retain full ownership of all artwork, logos, trademarks, and content you supply to us. By supplying such content, you grant The Print Expert a limited licence to use it solely for the purpose of producing your order. You warrant that you own or have the right to use all content supplied, and you indemnify The Print Expert against any claims arising from intellectual property infringement in content you have provided.
13.2 Our Work
Where The Print Expert creates original design work, the intellectual property in that work belongs to The Print Expert until full payment has been received, at which point ownership transfers to you.
All content on this website — including text, graphics, layout, and the The Print Expert brand — is owned by or licensed to The Print Expert and is protected by copyright. You may not reproduce, distribute, or use any website content without our prior written consent.
13.3 Portfolio Use
We reserve the right to feature completed work in our portfolio, on our website, and on our social media channels, unless you have requested confidentiality in writing prior to order confirmation.
14. Confidentiality
Where either party discloses confidential business information in the course of a project — including unreleased product information, business strategies, or sensitive commercial data — both parties agree to treat such information as strictly confidential and not to disclose it to any third party without prior written consent, except as required by law.
This obligation of confidentiality shall survive the completion or termination of any project or agreement.
15. Website Use
You may use our website for lawful purposes only. You agree not to:
- Use our website in any way that violates applicable laws or regulations;
- Transmit any unsolicited or unauthorised advertising material;
- Attempt to gain unauthorised access to any part of our website or its underlying systems;
- Introduce any viruses, malware, or harmful code;
- Scrape, copy or reproduce any website content without our consent.
We reserve the right to suspend or restrict access to our website at any time without notice. We do not guarantee that our website will be available continuously or free of errors.
16. Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any dispute arising out of or in connection with these Terms or our services shall first be referred to good-faith negotiation between the parties.
If a dispute cannot be resolved by negotiation within 30 days of written notice, either party may refer the matter to the courts of Tanzania, which shall have exclusive jurisdiction.
Nothing in this clause prevents either party from seeking urgent injunctive relief from any competent court.
